JUDGMENT / ORDER

Shahabuddin @ Mullah, S/o Abdul Ahmed, aged about 41 years, welding work, Rajappa Building, Thirmugondanahalli village, Attibele Hobli, Anekal Taluk, Own Address, Pardiya Dhomkal Thana, Murshidabad, (W.B).
(Since 22.06.2017 in J.C.) …Petitioner (By Sri C.N.Raju, Advocate) And The State by Dabaspete Police, Rep. by State Public Prosecutor, High Court of Karnataka, Bengaluru-560001. Respondent (By Sri S.Vishwamurthy, HCGP.) This criminal petition is filed under Section 439 of Cr.P.C praying to enlarge the petitioner on bail in Cr.No.154/2017 of Dobbespet Police Station, Bengaluru District, for the offence P/U/S 489B, 420 r/w 34 of IPC.
This Criminal Petition coming on for Orders this day, the Court made the following:
O R D E R Heard learned counsel for the petitioner and learned High Court Government Pleader for the respondent-State.
2. The petitioner (A9) along with seven others, are chargesheeted by the respondent-police in respect of the offences punishable under Sections 489-B, 120-B r/w Section 149 of IPC.
3. The allegation is, the petitioner along with accused No.3 was circulating fake currency notes supplied to him by accused No.1, 6 to 8. He was arrested on 22.06.2017 and thirty fake currency notes pertaining to the period of pre-demonetization were recovered from his possession.
4. Petitioner is not shown to have antecedents of similar offences.
In the light of the above, the petition is allowed. Petitioner is enlarged on bail in Cr.No.154/2017 registered by the respondent-police, subject to the following conditions:
(i) He shall execute a self bond for a sum of Rs.50,000/- with one surety for the likesum to the satisfaction of the concerned Court.
(ii) He shall attend the Court regularly on all hearing dates; and (iii) He shall not threaten the prosecution witnesses.
