1. Shri Hemang Parikh, learned advocate appearing for Shri R.C. Jani, learned advocate appearing on behalf of the respondents has stated at the bar that to the best of his information and knowledge the sole appellant-Shri Manilal Dahyabhai has expired.
2. Shri Suresh M. Shah, learned advocate appearing on behalf of the appellant prays for time to inquire and bring the heirs of the appellant on record. Hence, stand over to 04/07/2012. If, no steps are taken either to bring the heirs of the appellant on record or to substitute any other person, the present Second Appeal would be dismissed as having been abated.
