Heard Sri Anuj Pratap Singh, Advocate holding brief of Sri Mukesh Kumar, learned counsel for the petitioner.
In view of the order proposed to be passed, notices need not go to the respondents.
The petitioner has preferred the present petition under Article 227 of the Constitution of India inter-alia with the prayer to direct the court below i.e. Civil Judge (Senior Division)/FTC Farrukhabad to decide the impleadment application filed in Original Suit No.20 of 2004 (Bihari Lal Sanskrit Pathshala, Vs. Radha Krishna and another) within stipulated period.
Sri Anuj Pratap Singh, learned counsel for the petitioner vehemently argued that though the application for impleadment as provided under Order I Rule 10(2) CPC has been filed by the petitioner in the aforesaid suit on 25.07.2019, till date no final decision has been taken on the same and prays for expeditious disposal of the same.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the court below to consider and decide the aforesaid application in accordance with law expeditiously and preferably within a period of four months from the date of production of a self attested computer generated copy of this order downloaded from the official website of High Court Allahabad but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties.
