----------------------- The petitioner’s vehicle bearing Reg.No. KL-07J/4584 has been seized alleging transportation of river sand without valid permit. The petitioner submits that he is entitled for interim custody.
2. In view of the alternate remedy available before the competent jurisdictional magistrate under Section 23A of the Kerala Protection of River Banks and Regulation of Removal of Sand Act, 2001. Therefore, the Sub Inspector of Police shall report seizure of the vehicle within three days from the date of receipt of a copy of the judgment. If the petitioner moves an application before the competent jurisdictional magistrate, the competent jurisdictional magistrate shall consider the application within ten days of moving such application. The first respondent is directed to finalise the confiscation proceedings within a period of two months.
The writ petition is disposed of.
