The petitioner herein is the accused in C.P No.30/2014 before the Judicial First Class Magistrate Court, Chalakkudy. The case was transferred to the register of long pending cases as LP 82/2014. The major offence involved in the crime is under Section 308 IPC. On the apprehension of arrest in execution of the warrant of arrest the petitioner seeks direction to the court below to consider his application for bail on surrender. Of course, a direction as sought can be granted in the interest of justice. But there cannot be a direction to grant bail. The petitioner will have to surrender, and make application for regular bail. In the result, this petition is closed with direction to the court below, that in case the petitioner surrenders in C.P 30/2014 in L.P 82/14, and makes application for bail on surrender, the same shall be judiciously considered and decided on the date of surrender itself, however with notice to the other side. The petitioner is granted time for 7 days to surrender. During this period warrant of arrest will be kept in abeyance.
