Admittedly, no proceedings are pending before the court below. If that be so, in view of the decision of the Apex Court in the case of State of Punjab vs. Devindar Pal Singh Bhullar & Others (2011) 14 SCC 770 the application under Section 482 Cr.P.C is itself not maintainable.
The application is dismissed as not maintainable.
