The petitioner had availed a loan of Rupees three lakhs from the Kalakodu Service Co-operative Bank Ltd, Kollam. He defaulted payment of the instalments due to financial difficulties. Therefore, the bank initiated Arbitration Proceedings against him for recovery of the amount. An Award has been passed against him which is pending execution. The petitioner has been served with Exhibit P1 demand notice for an amount of ₹5,23,212/-. The petitioner has submitted Exhibit P2 representation seeking a facility to pay the entire amount in twenty four equal monthly instalments. He complains that no action has been taken thereon, till date. The counsel for the petitioner submits that this writ petition could be disposed of directing Exhibit P2 to be considered. 2. consider it necessary to issue notice to respondents 1 and 2. The Government Pleader appears for the third respondent.
This writ petition is therefore disposed of directing the first respondent to consider Exhibit P2 representation submitted by the petitioner in accordance with law, after affording an opportunity of being heard to the petitioner also and to pass appropriate orders thereon, as expeditiously as possible and at any rate within a period of one month of the date of receipt of a copy of this judgment. The petitioner shall be at liberty to produce a certified copy of this judgment before the first respondent for proper compliance.
