Counsel for the respondents states that against the impugned order rejecting application for temporary injunction, the petitioner has already filed an appeal. It is pending before the District Judge. It is urged that in such circumstances, the instant petition is not maintainable.
Counsel for the petitioner is not in a position to dispute the submission made by learned counsel for the respondents.
Consequently, the instant petition is dismissed but without prejudice to the right of the petitioner to prosecute the appeal which is stated to be pending before the District Judge.
