Learned counsel for the applicant is permitted to correct prayer clause of the Application.
Heard Sri O.P. Chaturvedi, Advocate holding brief of Sri Alok Kumar Tiwari, learned counsel for the applicant as well as learned AGA for the State and perused the record.
Present application has been filed by the applicant seeking a direction to the Civil Judge(Jr. Div.)/FTC, Mirzapur to decide the Criminal Case No.1248 of 2016(State vs. Raju Ali and others) arising out of Case Crime No. 886 of 2013 under section 498-A, 323, 504, 506 IPC and 3/4 Dowry Prohibition Act, Police Station Adalhat, District Mirzapur, within a stipulated time period.
It is submitted by the learned counsel for the applicant that the applicant is complainant/informant and the case is pending since 2016 due to delaying tactics adopted by opposite party Nos.2 to7 and only prayer is to direct the Court concerned for expeditious disposal of the same.
Learned AGA has no objection to the prayer made in this application.
Without going into merit of the case, it is appropriate that the above Case be decided expeditiously.
In view of above, the Civil Judge(Jr. Div.)/FTC, Mirzapur is directed to expedite and conclude the proceedings of Criminal Case No.1248 of 2016(State vs. Raju Ali and others) arising out of Case Crime No. 886 of 2013 under section 498-A, 323, 504, 506 IPC and 3/4 Dowry Prohibition Act, Police Station Adalhat, District Mirzapur within one year from the date of production of copy of this order without granting adjournment unnecessarily to either of the parties, unless there is any legal impediment.
With aforesaid direction, the application under Section 482 Cr.P.C. is finally disposed of.
