(Per : HONOURABLE MR.JUSTICE AKIL KURESHI) The applicants - original claimants have filed first appeal for further enhancement of compensation awarded by the Claims Tribunal under the impugned award. It is their case that they are not possessed of sufficient means for affixing the Court fees required for pursuing the appeal.
Learned counsel Ms. Ami Patel for respondent No.3 Insurance Company has, however, stated that the Insurance Company has deposited entire amount awarded by the Claims Tribunal with proportionate costs and interest. Out of the said amount deposited, 30% that is Rs.2,94,700.00 is already disbursed in favour of the claimants. Under the circumstances, the claimants cannot be considered to be indigent persons who are unable to pay the Court fees. This application is, therefore, dismissed. Claimants are given time upto 31st March, 2012 to pay the Court fees on the first appeal.
