Heard Mr. Ajey Singh, learned counsel for the petitioner and Mr. S.P. Singh, learned A.G.A. for the State.
The present writ petition has been filed by the petitioner, Shabbir for the following reliefs:-
"i. Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties No. 1 & 2 to ensure that fair and speedy investigation of F.I.R./Case Crime No.0110/2011, Under Section-323, 452,363, 366-A of I.P.C. Police Station- Sonwa, District Shrawasti, which is not being done by the opposite party No.3, by transferring it to some other police station or agency.
ii. Issue a writ, order or direction in the nature of Mandamus commanding the opposite parties No.1 to 3 to recover the minor girl of the petitioner namely Muskan and protect the personal life & liberty of the petitioner"
Learned counsel for the petitioner submits that the petitioner is the informant of the case. He lodged the present F.I.R. on 15.07.2021 but till date investigation has not been concluded, hence he has come up before this Court by filing the present petition.
Learned A.G.A. could not dispute the aforesaid fact as argued by learned counsel for the petitioner.
Considering the facts and circumstances of the case, we direct the Investigating Officer of the present case to conclude the investigation of the present case and submit a police report before the Magistrate concerned expeditiously preferably within a period of six weeks from the date of production of a certified copy of this order in accordance with law.
The Superintendent of Police, Shrawasti- respondent no.2 shall ensure the compliance of present order within the aforesaid period.
With the above directions, this writ petition is finally disposed of.
