Petitioner has retired from the employment of respondent Uttar Pradesh Jal Nigam on 30.6.2017. Grievance is that though other retiral benefits due and payable have been released to petitioner but amount of leave encashment has not been paid to petitioner so far.
Sri Pranjal Mehrotra, learned counsel for the respondents states that on account of financial crisis the amount of leave encashment could not be paid to petitioner and that such amount shall be released within a reasonable period.
Law is settled that payment of retiral benefits is the entitlement of an employee for the past services rendered and and such benefits cannot be withheld indefinitely.
In view of the above, this petition is stands disposed of with a direction upon the respondent nos. 2 and 3 to release withheld amount of leave encashment to petitioner within a period of 4 months from today, failing which petitioner shall also be entitled to interest at the rate of 8% per annum.
