Heard learned counsel for the petitioners and Mrs. Archana Singh, learned AGA-I for the State-respondents.
This writ petition has been filed with the prayer to quash the First Information Report (FIR) dated 10.3.2021 in Case Crime no. 79/2021 under Section 498-A, 323, 504, 506 IPC and Section 3/4 D.P. Act, P.S. Qilla, District Bareilly. Further prayer has been made not to arrest the petitioners in the aforesaid case crime.
Learned counsel for the petitioners submits that the husband of the complainant has died and the matter has amicably been resolved between the parties.
The said position is endorsed by Mrs. Archana Singh, learned A.G.A.-I for the State-respondents.
In the facts and circumstances of the case, once the matter is already resolved, then it is expected from the Investigating Officer to proceed as per the provisions contained under Section 169 Cr.P.C.
The writ petition is disposed of.
