THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No.22679 of 2014 Order: (per Sri Sanjay Kumar,J) This petition, seeking a Writ of Habeas Corpus, is in connection with the husband of the petitioner, who is stated to be missing.
Going by the averments of the petitioner in her affidavit filed in support of this Writ Petition, it is clear that it is not a case of illegal detention rather her husband is alleged to be missing.
We are of the opinion that a Writ of Habeas Corpus cannot be issued in the given fact. The petitioner is to approach appropriate forum to seek appropriate relief.
The Writ Petition is dismissed giving liberty to the petitioner to do so. Pending Miscellaneous Petitions, if any, shall stand dismissed. There shall be no order as to costs.
