Applicant has filed this application under section 482 Cr.PC with prayer seeking direction to Addtional Chief Judicial Magistrate, Court no. 10, Varanasi to expedite the proceedings of case no. 3404 of 2017 (Shabana Bano @ Reshma Bano vs. Rashid Khan), under section 12 of Domestic Violence Act, P.S. Sigra, District Varanasi, pending in the court of Additional Chief Judicial Magistrate, Court no. 10, Varanasi.
It is contended by learned counsel for the applicant that above mentioned criminal case is pending in the court of Additional Chief Judicial Magistrate, Court no. 10, Varanasi since 02.09.2017 but no action is being taken therein. It is further contended that on account of no action being taken in the matter applicant is being unnecessarily harassed.
In the circumstances, Additional Chief Judicial Magistrate, Court no. 10, Varanasi is directed to expedite the hearing of case no. 3404 of 2017 (Shabana Bano @ Reshma Bano vs. Rashid Khan), under section 12 of Domestic Violence Act, P.S. Sigra, District Varanasi, pending in his court and is further directed to decide the same expeditiously, preferably within a period of six months, if possible from the date of production of certified copy of the order.
Application stands disposed of accordingly.
