The petitioner is aggrieved against Clause 6(a) of the impugned Tender notification, wherein a condition was stipulated that the tenderers who have atleast 5 years of experience alone can participate in the tender process.

Mr.M.Santhanaraman, learned Additional Government Pleader, who takes notice for the respondents, based on instructions, submitted that the grievance of the petitioner is not subsisting any more in view of the subsequent development viz., an amendment brought in the tender notification, wherein Clause 6(a) is amended as follows: "The tenderers who are supplying feed items to the Arignar Anna Zoological Park (or) experience in execution of similar nature of work / Supplies in various recognized institutions/ organizations of Government/ Government aid/ funded in the past with at least 5 years of experience shall enclose certified copies of their credentials, & Without above said documents no Bid shall be treated as valid." Therefore, he submitted that the petitioner who is the existing supplier is not prevented from participating in the tender process.
3. Learned counsel for the petitioner submitted that the above statement may be recorded and the writ petition may be closed.
4. Accordingly, recording the above statement made by the learned Additional Government Pleader appearing for the respondents, this writ Petition is closed as nothing survives to be adjudicated upon further. No costs. Consequently, connected miscellaneous petition is closed.
