Petitioner's vehicle bearing registration No.KL-9-R-5445 has been seized alleging that the vehicle has been transported minor mineral in contravention of the Minor Mineral Rules. Petitioner submits that the original vehicle bearing registration No.KL-9-AA- 3319 was met with a break down and the transported articles were removed from the vehicle.
2. Considering the facts and circumstances, there shall be a direction to the second and third respondents to release the vehicle on executing a simple bond. However, it is made clear that this will not stand in the way of authorities prosecuting the petitioner, if it is so warranted.
The Writ Petition is disposed of.
