Sethu Rathnam vs Ammini

High Court Of Kerala|11 December, 2014
|

JUDGMENT / ORDER

The only complaint in this petition is that the execution petition filed by the petitioner is not being proceeded with and that causes irreparable loss and injury to the petitioner.
2. The execution petition was filed as E.P.No.
517/2014 only on 07.06.2014. It is also seen from the records that petitioner had filed E.A.No.179/2014 for issuance of a Commission to demarcate the property.
3. The grievance of the petitioner is that even though the respondent has entered appearance, the matter is not taken into consideration by the court below.
4. In the light of the order that is proposed to be passed, it is felt that notice to the respondent is unnecessary.
Therefore, there will be direction to the Munsiff Court, Kodungallur to take up E.P.No. 517/2014 and dispose it of on O.P.(C) No. 2962 of 2014 -2-
merits in accordance with law, as expeditiously as possible, at any rate, within a period of four months from the date of receipt of a copy of this judgment.
