Short counter affidavit filed today on behalf of opposite party no. 2 alongwith vakalatnama is taken on record.
The present application under Section 482 Cr.P.C. has been filed for quashing the summoning order dated 16.11.2016 as well as the entire proceedings of Complaint Case No. 284 of 2016 (Nshirunnisha Vs. Seraj Ahmad and others), under Section- 498-A, I.P.C. and Section 3/4 Dowry Prohibition Act, Police Station- Mehdawal, District- Sant Kabir Nagar, pending before Civil Judge (S.D.)/Additional Chief Judicial Magistrate, Sant Kabir Nagar.
It is contended by the learned counsel for the applicants that the matter had already been settled between the parties and the compromise in this regard had already been filed alongwith an application on 18.09.2019, which remained pending before the trial court.
In paragraph no. 4 of the short counter affidavit filed by opposite party no. 2, it is stated that she does not want to press her complaint and she has no objection in case the proceedings of the aforesaid case are hereby quashed.
In view of the above, the proceedings of the aforesaid case are hereby quashed.
The application stands allowed.
