The petitioner/wife has filed the above Transfer Civil Miscellaneous Petition to withdraw H.M.O.P.No.374 of 2013 pending on the file of the Family Court, Coimbatore and transfer the same to the file of the Family Court, Chennai.
2. It is stated that the respondent-husband is running a shop in Coimbatore. He filed H.M.O.P.No.374 of 2013 for divorce before the Family Court at Coimbatore. He also filed H.M.O.P.No.356 of 2012 for restitution of conjugal rights, which was dismissed on 24.05.2013 by the Family Court, Coimbatore.
3. It is also further stated that the petitioner was sent out of the matrimonial home and she is now residing in her brother's house in Chennai. It is the grievance of the petitioner that she has to travel 400 kms from Chennai to Coimbatore for hearing of the case. She is depending on her brother's income. Hence, she finds it difficult to travel from Chennai to Coimbatore coupled with the fact that she is dependent financially on her brother. She is unable to make arrangements for engaging an Advocate. Hence, the petitioner has filed this transfer petition.
4. Though the respondent was served with notice, there is no representation for him either in person or through counsel.
5. Taking into consideration of the above facts and also the grievance of the petitioner, this Tr.C.M.P. is allowed and H.M.O.P.No.374 of 2013 from the file of the Family Court, Coimbatore shall stand withdrawn and is transferred to the Family Court, Chennai . No costs. Consequently, connected miscellaneous petition is closed.
