JUDGMENT / ORDER

The accused in crime No.1053/2011 of Kasaragod Police Station pending in CP.No.36/2013 before the Judicial First Class Magistrate Court-I, Kasaragod are the petitioners. First respondent is the de facto complainant. First respondent alleged offences punishable under Sections 341, 323, 324, 427 and 308 r/w. 34 IPC against the petitioners. The incident was happened on 10.11.2011 at about 8.45 pm. The accused allegedly attacked the de facto complainant and caused injuries to him.
2. Heard the learned counsel for the petitioners and the counsel for the de facto complainant. Heard the learned Public Prosecutor also.
3. It is seen from Annexure-A2 affidavit that the parties have settled the matter out of court. The de facto complainant averred that he has no grievance against the
Crl.M.C.No.2555/2014.
2 petitioners and he is a willing party to see that the prosecution is terminated. Considering the entire facts and circumstances, I find that no purpose will be served by further prosecuting the case.
4. In the result, this petition is allowed. Annexure- A1 Final Report pending before the Judicial First Class Magistrate Court-I, Kasaragod in CP.No.36/2013 is hereby quashed.
