JUDGMENT / ORDER

The petitioner approached this Court aggrieved by Ext.P3 notice issued by the Tahsildar directing the petitioner to remove branches of a tree. It is stated that this branches of tree causing obstruction to the paddy cultivated by the party respondent. There is no power traceable to the Tahsildar to issue such order. If at all the 4th respondent has any grievance of public nuisance, he is free to approach the Revenue Divisional Officer in terms of Section 133 of Criminal Procedure Code. The party respondent submits that the petitioner has reclaimed land in contraventions of Kerala Land Utilisation Order, 1967. If the petitioner has reclaimed such land, it is open for the party respondent to approach such an authority against reclamation of land. Therefore, with liberty to take W.P.(C). No.21208 of 2014 -: 2 :-
appropriate action in terms of Kerala Land Utilisation Order, 1967, Ext.P3 is quashed.
This Writ Petition is disposed of as above.
