JUDGMENT / ORDER

~ ~ ~ ~ ~ ~ Petition under Section 438 Cr.P.C. 2. Petitioner is the 3rd accused in Crime No.219/2014 of Vidura Police Station registered for the offences punishable under Sections 323, 324 and 307 read with Section 34 IPC.
3. On 23.03.2014 at 10.30 p.m. the 1st accused abused the de facto complainant on the pathway leading to the house of the de facto complainant and thereafter he hit him with a brick on his back and waist and also kicked him down. The 2nd accused fisted and stamped him. At that time, the present petitioner took a chopper and inflicted a cut on his neck, thereby causing an injury and thereby attempting to commit the murder of the de facto complainant.

4. Heard learned counsel for the petitioner and learned Public Prosecutor.
5. Earlier, there was an unsuccessful attempt from the part of the very same petitioner for getting anticipatory bail from this Court through B.A. No.6477/2014. Absolutely there is no change of circumstances at all. The allegations against the petitioner is very grave and serious. The contents of the CD, prima facie, reveal the complicity of the petitioner. Considering the seriousness of the allegations against the petitioner and the present stage of investigation, I am of the view that this is not a fit case wherein anticipatory bail can be granted to the petitioner.
In the result, this Bail Application is dismissed.
