JUDGMENT / ORDER

This case has been listed today and came up for settlement before the Lok Adalat. Mr.K.Balamurali, learned counsel for the Appellant alone present. http://www.judis.nic.in 2 LOK ADALAT AWARD The appeal in CMA.No.2842 of 2017 pending on the file of High Court, Madras and preferred against the award passed in W.C.No.513 of 2007 on the file of the Commissioner for Workmen Compensation (Deputy Commissioner of Labour), Salem, has been referred to Lok Adalat for conciliation today.
2. This is a case of Motor Accident causing death to the husband of appellant herein, while he was in duty. The Commissioner for Workmen Compensation (Deputy Commissioner of Labour), Salem has awarded a sum of Rs.4,18,460/- (Rupees Four Lakhs Eighteen Thousand Four Hundred and Sixty only) as compensation, to be paid by the Insurance Company, within 30 days from the date of receipt of the award.
3. Not satisfied with the award of the Commissioner for Workmen Compensation (Deputy Commissioner of Labour), Salem, the appellant/first claimant has preferred this appeal for enhancement of compensation.
4. When the Appeal is taken up today, learned counsel for appellant submits that the matter is settled out of Court. Endorsement is made by the counsel for the appellant as follows:
“On instructions from the petitioner Mrs.Selvi by a letter requesting us to withdraw as the case is settled out of Court. The above CMA may be permitted to withdraw.” http://www.judis.nic.in 3
5. In view of the endorsement, the Civil Miscellaneous Appeal is settled out of Court as withdrawn. No order as to costs.
Counsel for the Appellant This Lok Adalat award is passed accordingly.
The full Court fee paid shall be refunded to the appellant in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994.
