The petitioner/wife has come before this Court seeking to withdraw the proceedings in H.M.O.P.No.136 of 2016 on the file of the Sub Court, Pudukkottai and transfer the same to any other competent Court at Tiruchirappalli.
2. The petitioner/wife and the respondent/husband got married on 25.03.2012 and out of wedlock, a male baby was born to them. Due to misunderstanding, they are living separately. Meanwhile, the respondent/husband filed H.M.O.P.No.136 of 2016 on the file of the Sub Court, Pudukkottai, for divorce. Only to transfer the said petition, this petition has been filed.
3. Heard the learned Counsel for the petitioner/wife and the learned Counsel for the respondent/husband and perused the materials available on record.
4. Though the learned Counsel for the respondent/husband has no objection for allowing this petition, he prays for early disposal of H.M.O.P.No.136 of 2016.
5. Since the petitioner/wife is living with her child in Trichy, it is very difficult for a lady to travel from Trichy to Pudukkottai, for every hearing. The place of residence of the petitioner/wife is the appropriate place for trying the case.
6. Therefore, H.M.O.P.No.136 of 2016 on the file of the Sub Court, Pudukkottai, is withdrawn and transferred to the Principal Sub Court, Trichy.
7. At this juncture, the learned Counsel for the petitioner/wife submitted that the petitioner/wife will file counter statement in the petition filed by the respondent/husband for divorce within two weeks from the date of receipt of a copy of this order. The said submission is placed on record.
8. Accordingly, this Transfer Civil Miscellaneous Petition is ordered as above. The Principal Sub Court, Trichy, is directed to dispose of H.M.O.P.No.136 of 2016 as expeditiously as possible, not later than 31.08.2017. No costs. Consequently, the connected civil miscellaneous petition is closed.
