JUDGMENT / ORDER

Sagaya Mary ... Respondent Prayer : Civil Miscellaneous Appeal filed under Section 55 of the Divorce Act, 1869, against the order and decree dated 09.11.2009 in I.D.O.P.No.115 of 2007 passed by the Principal District Judge, Villupuram.

J U D G M E N T
This Civil Miscellaneous Appeal has been filed against the order and decree dated 09.11.2009 in I.D.O.P.No.115 of 2007 passed by the Principal District Judge, Villupuram.
2. When the matter was taken up before the National Lok Adalat, dated 13.06.2015, the parties have arrived the settlement. The respondent consented for divorce and the appellant agreed to pay alimony of sum of Rs.2,75,000/- before the Lok Adalat. The appellant was paid a sum of Rs.1,75,000/- of the agreed amount and the remaining amount was undertaken to pay within a period of one month with interest at 12% per annum.
3. When the matter is taken up for hearing today (06.10.2017), the learned counsel for the appellant has submitted a demand draft bearing number 087318, dated 11.09.2017 drawn on the State Bank of India, Tirukkoyilur Branch, for a sum of Rs.1,24,000/-, of which Rs.1,00,000/- is balance and Rs.24,000/- is interest. The learned counsel for the respondent has submitted that the respondent is willing to receive the demand draft for a sum of Rs.1,24,000/- towards full and final settlement for the award passed by the Lok Adalat.
4. Recording the submissions made and the joint memo filed by the parties, this Civil Miscellaneous Appeal is ordered on the basis of the award passed by the National Lok Adalat, dated 13.06.2015.
5. Both the parties are present and the respondent/wife agreed to receive the demand draft, as mentioned above towards full and final settlement and accordingly I.D.O.P.No.115 of 2007 is allowed. Divorce is granted on the basis of the joint memo filed by the parties.
6. With the above observation, this Civil Miscellaneous Petition is ordered. No costs.
