Heard learned counsel for the petitioner, Sri Ajit Kumar Srivastava holding brief of Sri Anuj Kumar, learned counsel for the respondent no.3 and learned Standing Counsel appearing for respondents no. 1 and 2.
By means of present writ petition, the petitioner seeks writ of certiorari quashing the order dated 8.12.2017 passed by the respondent no.2- Sub Divisional Magistrate, Atarra, District Banda for the allotment of fair price shop of Gram Sabha Dadawamanpur post Fatehganj, District Banda.
Learned counsel for the respondent states that against the said order, the appeal is provided under Clause 13 (1) of Uttar Pradesh Essential Commodities (Regulation of Sale and Distribution Control) Order, 2016.
Since, there is an alternative remedy available to the petitioner, the writ petition is dismissed on the said ground. No order as to cost.
