JUDGMENT / ORDER

This appeal has been preferred against the judgment and decree dated 10.12.2002 by the Family Court, Madurai, in O.S.No.10 of 1997 which was filed by the appellant under Hindu Adoption and Maintenance Act for declaring that the appellant is entitled to have a separate residence and for directing the first defendant / husband to provide a separate living to the plaintiff without the intervention of the second defendant. The suit is also for granting permanent injunction restraining defendants 1 and 2 in the suit from interfering with peaceful living of the plaintiff in the suit property.
2.It is reported that the appellant / plaintiff in the suit, died in the year 2015. Having regard to the nature of relief prayed for by the appellant / plaintiff, it appears that the appeal has become infructuous on the death of the appellant / plaintiff and that therefore nothing survives in this appeal to be adjudicated. Hence, this appeal is not likely to be prosecuted by the legal representatives of the deceased appellant. This appeal is therefore dismissed as infructuous. No costs. Consequently, the connected miscellaneous petition is closed.
