THIS CRIMINAL PETITION COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Heard the learned counsel appearing for the petitioner/accused and the learned High Court Government Pleader appearing for the respondent-State.
2. The petitioner apprehends arrest by the respondent-police in their Cr.No.2/2017 in respect of the offences punishable under sections 504, 506, 354-B, 114 r/w section 34 of IPC.
3. The allegation is, the petitioner being the nephew of the complainant’s husband used to make sexual advance to the complainant and on the eve of new year, man handled her etc.
4. The co-accused are said to have been enlarged on bail in Crl.Mis.No.5008/2017 dated 28.1.2017. The petitioner claims innocence. In the given circumstance, there is no impediment to allow the petition.
Accordingly, the petition is allowed. Petitioner is granted anticipatory bail in Cr.No.2/2017 for a period of three weeks. Within the above period, he shall surrender before the concerned Court and move for regular bail. Till disposal of the regular bail petition, this order will be in force. In the event he is arrested by the respondent-I.O. within the above period, he shall be enlarged on bail on his executing a self bond for Rs.50,000/- with one surety for the likesum. He shall co-operate with the Investigating Officer during further course of investigation.
