By way of this petition, the petitioners have prayed that this Court may quash the First Information Report being Case Crime No.88 of 2021 lodged on 21.2.2021 under Section 406 & 420 of I.P.C. at Police Station, Kotwali, Distt. Shahjahanpur against the petitioners.
Learned counsel for the petitioner, after this Court has shown its disinclination to interfere with the investigation or to quash the F.I.R., has sought permission to withdraw this petition.
He is permitted to do so.
However, we observed that the offences which are alleged in the F.I.R. have maximum punishment of seven years and, therefore, the police authority will adhere to the provisions of Section 41 of Cr.P.C. and will investigate the matter in fair manner as the petitioners have also lodged another F.I.R. against the private respondent who has business transactions with petitioners.
In view of the above, this petition is dismissed as withdrawn.
