1. Heard learned counsel for the parties.
2. The present contempt petition has been filed for alleged non-compliance/disobedience of the judgment and order dated 06.08.2018 passed by the Division Bench in Special Appeal No.353 of 2005.
3. Vide the said judgment and order, the special appeal filed by respondents-State of U.P. and another got dismissed.
4. The present contempt petition has been filed, alleging that though the petitioner has been reinstated in service on 1st of October, 2018, but she has not been paid salary for the period 16.05.2018 to 30th of September, 2018 till date.
5. I have gone through the judgment and order in question. I do not find that a direction for giving salary to the petitioner for the period 16.05.2018 to 30.09.2018 was issued vide aforesaid judgment and order in question.
6. In view of the above, this contempt petition is misconceived and is dismissed accordingly. However, as learned counsel for the petitioner has lastly submitted that the petitioner will not claim salary for the period 16.05.2018 to 30.09.2019, it is directed that the petitioner shall be given continuity in service.
