The petitioner is seeking for quashing of the select list declared on 22.12.2014 on the post of ANM (Auxiliary Nurse Midwives) under the National Rural Health Mission Scheme sponsored by the State Government.
It is contended that the petitioner having attained requisite training as required for selection had appeared in the selection process.
The selection committee, however, selected few persons who were trainees of second batch. The selection, according to the petitioner, is contrary to the provision of the U.P. Medical Health and Family Welfare Department Health Workers and Health Supervisors (Male & Female) Service Rules' 1997. It is thus contended that in the selection even the persons lower in the merit have been selected.
The petitioner being higher in merit had a right to seek selection on the said post. The allegation made in the writ petition to challenge the select list finalized on 22.12.2014 are too vague. It is admitted to the petitioner that she had participated in the selection process but could not qualify.
It is settled law that a select list cannot ordinarily be interfered by this Court on the vague assertion of irregularity in making selection. No-one has been made party by name in the present writ petition. There is no detail as to who are those candidate who have not qualified but selected. The marks obtained by the petitioner in the selection are not on record.
Apart from the above, the present petition has been filed after a period of four years without any explanation as to why the petitioner has come so late.
