The instant bail application has been filed on behalf of the applicant with a prayer to release him on bail in Case Crime No. 1006 of 2018, under Section 420 I.P.C., police station Kavinagar, district Ghaziabad during the pendency of trial.
It is argued by the learned counsel for the applicant that accused applicant has falsely been implicated in the present case. It is further submitted that the dispute in the present case is of purely civil in nature. It is also submitted that late husband of the applicant namely Rajesh Sharma, who was also summoned as co-accused was granted bail by this Court vide order dated 10.5.2018 in Criminal Misc. Bail Application No. 6113 of 2018. Therefore, the applicant is entitled for bail on the ground of parity. The applicant is languishing in jail since 19.1.2021. There is no prospect of trial of the present case being concluded in near future due to heavy dockets. In case she is enlarged on bail, she will not misuse the liberty of bail.
Per contra learned A.G.A. has opposed the bail prayer of the applicant by contending that innocence of the applicant cannot be adjudged at pre trial stage, therefore, the applicant does not deserve any indulgence. In case the applicant is released on bail she will misuse the liberty of bail.
Keeping in view the nature of the offence, evidence, complicity of the accused, submissions of the learned counsel for the parties, I am of the view that the applicant has made out a fit case for bail. Hence, the bail application is hereby allowed.
