Petition under Section 438 of CR.P.C., praying that in the circumstances stated in the petition and the grounds filed herein, the High Court may be pleased to direct the Station House Officer, Thallada Police Station, Khammam District to release the Petitioner/A2 on bail in the event of his arrest in connection with Crime No. 45 of 2014 of Police Station, Thallada, Khammam District.
The petition coming on for hearing, upon perusing the petition and the grounds filed herein, and upon hearing the arguments of Sri P. Prabhakar Reddy, Advocate for the Petitioner and of the Public Prosecutor on behalf of Respondent- State, the Court made the following.
ORDER:-
“The petitioner is A2. He seeks for grant of anticipatory bail. He allegedly committed offences under Sections 419 and 420 IPC. The brother of the petitioner allegedly misappropriated the petitioner in the examinations.
The learned counsel for the petitioner submitted that the petitioner did not commit the offence alleged against him. The petitioner is a CRPF Constable. In view of the calling of the petitioner and the nature of the offences alleged against him, I consider it appropriate to enlarge the petitioner on anticipatory bail.
Consequently, this Criminal Petition is allowed. The petitioner shall surrender before the learned Judicial Magistrate of First Class, Madhira, within two weeks from today. On such surrender, the learned Judicial Magistrate of First Class, Madhira, shall enlarge the petitioner on bail on a personal bond of Rs. 10,000/- (Rupees Ten Thousand Only) with two sureties in a likesum to his satisfaction.”
