JUDGMENT / ORDER

THE HON’BLE SRI JUSTICE R. SUBHASH REDDY AND THE HON’BLE SRI JUSTICE A. SHANKAR NARAYANA FAMILY COURT APPEAL Nos.39 AND 44 OF 2014 COMMON JUDGMENT: (Per Hon'ble Sri Justice R. Subhash Reddy) These two appeals, under Section 19 (1) of the Family Courts Act, 1984, are filed aggrieved by the common order, dated 22.02.2014, passed in O.P.Nos.460 of 2010 and 296 of 2013 by the Additional Family Court, Hyderabad.
O.P.No.460 of 2010 was filed by the appellant – husband seeking dissolution of marriage performed between himself and the respondent - wife, whereas O.P.No.296 of 2013 was filed by the respondent – wife seeking restitution of conjugal rights. The Family Court, by the impugned orders, dated 22.02.2014, while dismissing the petition filed by the appellant, allowed the petition filed by the respondent and ordered for restitution of conjugal rights. Aggrieved by the same, these appeals are filed by the appellant – husband.
When the matters came up earlier on 07.04.2014 and 21.04.2014, we have conducted reconciliation proceedings between the parties in the chamber in the presence of their Advocates. In the reconciliation proceedings, the parties have agreed to stay together.
Today, across the bar, it is stated that the parties are living together peacefully and happily and there are no disputes between them. The appellant has filed an affidavit stating that they have resolved the disputes and pursuant to reconciliation proceedings, they have taken a separate house at Block A-42, Flat No.407, Sanskruthi Townsip, Pocharum Village, Ghatkesar Mandal, Ranga Reddy District, and are living together. He has also requested to dispose of the appeals by giving liberty to him to agitate the matters afresh, if any situation arises in future.
In view of the affidavit filed by the appellant and in view of the settlement arrived at between the parties, both the appeals are disposed of confirming the impugned orders and decrees passed by the Family Court. However, in view of the apprehension of the appellant, liberty is given to him to agitate the matters afresh, if any such situation arises in future.
Miscellaneous Petitions, if any, pending shall stand closed. No costs.
