SHAH Date : 17/04/2012 ORAL ORDER Despite the fact that it was brought to the notice of the learned advocate for the appellants as far as back on 9.5.2011 that appellant no.4 has expired, no steps are taken to bring the heirs of appellant no.4 on record. Hence, present appeal is dismissed as having been abated so far as appellant no.4 is concerned. Though, the present Second Appeal is of the year 1991, it is reported that notice upon respondent nos. 1 /2 to 1 /4 and 1/6 has not been served. Hence, stand over to 26th April 2012. In the meantime, appellant to take steps to serve respondent nos. 1 /2 to 1 /4 and 1/6 , failing which present appeal shall be dismissed for non prosecution so far as respondent nos. 1 /2 to 1 /4 and 1/6 are concerned.
