Heard learned counsel for the petitioner. Notice on behalf of the respondents No.1 to 3 has been accepted by the office of the Chief Standing Counsel.
In view of the order proposed to be passed by this Court, notice to the private-respondent No.4 is dispensed with.
The petitioner has approached this Court with limited prayer that he has preferred an appeal under Section 13 of the U.P. Imposition of Ceiling of Land and Holdings Act, 1960 which is pending before the respondent No.2. The aforesaid appeal was admitted by means of the order dated 19.09.2019, however, his application for interim relief is pending and no orders have been passed.
It is further submitted that though a number of dates have been fixed, however, no orders have been passed and in the aforesaid backdrop the State if proceeding to allot the land in question. It is in the aforesaid backdrop, it is prayed that the application for interim relief may be decided expeditiously.
Considering the facts and circumstances as well as the fact that the appeal of the petitioner was admitted on 19.09.2019 and the petitioner had moved an application for interim relief on 04.12.2019, which is said to be pending before the appellate authority, accordingly, this Court is of the opinion that ends of justice can be served by directing the lower appellate authority i.e. respondent No.2 to consider, hear and finally decide the pending application for interim relief expeditiously. Since, it has been informed that the next date is fixed on 23.03.2021, liberty is granted to the petitioner to move an application for preponement of date before the appellate authority. In case, such an application is made, the authority shall prepone the date and decide the application preferably within a period of two weeks from the date such an application for preponement is made.
With the aforesaid, the writ petition is disposed of.
