JUDGMENT / ORDER

The petitioner claims to be beneficiary of an unregistered 'Will'. The property originally belongs to the petitioner's father. It is submitted that the father is no more. Ext.P2 is the death certificate. The petitioner submits that his mother has certain rights on the said 'Will' and now his mother is also no more. 2. Registration of the 'Will' is not compulsory for acting upon the terms of the 'Will' . The transfer of Registry is effected for fiscal purpose. The right available to the 3rd parties in the property will not be lost merely because the transfer of registry is effected. Therefore,there shall be a direction to the 2nd respondent to effect transfer of Registry based on unregistered 'Will' without further delay.
The writ petition is disposed of as above.
