Madras High Court|22 November, 2017

JUDGMENT / ORDER

This writ petition has been filed, seeking to direct the 2nd respondent to dispose of the appeal pending in Na.Ka.Aa6/4802/2012 and consequently to direct the respondent to sub-divide and issue patta to the petitioner's name in respect of the lands comprised in S.No.510/1A with extent of 1 Acre 30 cents in Pandavarmangalam Village, Kovilpatti Taluk, Tuticorin District.
2.Heard both sides.
3.By consent, the writ petition is taken up for final disposal at the stage of admission itself.
4.The learned counsel for the petitioner would submit that the petitioner applied for a separate patta in respect of his property to the third respondent, who, in turn, forwarded the same to the second respondent. Though the second respondent initiated proceedings as early as on 07.03.2013, still, no final orders have been passed. Hence, the petitioner is before this Court.
5.The learned Special Government Pleader appearing for the respondents would submit that the representation of the petitioner would be considered on merits within the time stipulated by this Court.
6.Considering the limited scope of the relief sought in this writ petition, this Court, without going into the merits of the case, directs the second respondent to dispose of the proceedings in Na.Ka.Aa6/4802/2012 dated 07.03.2013 by passing appropriate orders, on merits and in accordance with law, after affording due opportunity of hearing to the petitioner as well as all the interested parties, if any, within a period of six weeks from the date of receipt of a copy of this order, if already not passed.
7. The writ petition is disposed of as above. No costs.
To
1.The District Revenue Officer, Tuticorin District, Tuticorin.
2.The Revenue Divisional Officer, Kovilpatti, Tuticorin District.
