Schlumberger Asia Service Limited Plot No.5 and 6, Industrial Estate, Dowleswaram Rajahmundry East Godavari District Rep. by Retna Raj Ratnasabapaty … Petitioner And Government of Andhra Pradesh Rep. by its Principal Secretary (Transport) Secretariat Hyderabad and others … Respondents THE HON’BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON’BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION NO.15204 OF 2014 ORDER: (per the Hon’ble the Chief Justice Sri Kalyan Jyoti Sengupta) Having heard the learned counsel for the parties, we are of the view that the writ petition should not be entertained right now. Therefore, we allow the writ petitioner to file a comprehensive reply to the impugned demand raising all the points which are raised before us. After receipt of the same, the concerned respondent authority shall decide the matter in accordance with law, after giving personal hearing to the writ petitioner, within a period of four weeks from the date of communication of this order, by passing a speaking order. The aforesaid exercise shall be undertaken provided the writ petitioner submits reply within a period of fifteen days from the date of communication of this order.
In the meantime, in the event the writ petitioner deposits 50% of the demanded amount and secures balance 50% by furnishing bank guarantee from a Nationalized Bank, then the vehicle in question shall be released and shall be allowed to be plied in accordance with law. In the event such deposit is not made or the bank guarantee is not furnished, then this order of release of the vehicle will stand recalled.
The writ petition is accordingly disposed of. There will be no order as to costs.
Consequently, pending miscellaneous petitions, if any, shall stand closed.
