S.Chandrakala vs J.Suresh

Madras High Court|01 March, 2017

JUDGMENT / ORDER

This revision petition is filed by the petitioner-wife and minor children seeking early disposal of interlocutory application in I.A.No.432 of 2016 in O.P.No.4384 of 2014 on the file of the II Additional Family Court, Chennai.
2. Now it is stated that in the grounds, the I.A is pending from September 2015. It appears that it has been filed into court on 16.02.2016. From the endorsements made in the application, it is noticed that wife has not been appearing before the Court from October 2016 and it has been adjourned for appearance of the wife as a last chance. Now, the revision petitioner, who is the wife of the respondent, is seeking for early disposal of application even without appearing before the Court and such an attitude of the wife cannot be encouraged. Though the Family Judge is required to dispose of the application for claim of interim maintenance, unless the parties co-operate in the disposal of the same, it will be difficult for the Family Court to dispose of the interlocutory application. Hence, this Court is not inclined to give a direction to the Family Court, Chennai by fixing a time frame. However, considering the convenience of the wife and children, the application may be disposed of as expeditiously as possible. No costs.
