JUDGMENT / ORDER

These two writ petitions have been filed seeking a common prayer for issuance of a writ of mandamus, directing the Registrar of Co-operative Societies (Housing), the first respondent herein to pass appropriate orders on the representations of the petitioners dated 25.1.2017.

The petitioner in W.P.No.3747 of 2017, namely, Mrs.S.Brinda was working as Personal Assistant in the Information and Public Relation Department and the petitioner in W.P.No.3748 of 2017, namely, Mrs.J.Saroja was working as Section Officer in the Highways Department. While they were the members in the Tamil Nadu Secretariat Employees Co-operative Housing Society, they were allotted plots bearing Plot No.325 measuring 1550 sq.ft., in the Secretariat Colony and Plot No.246 measuring 1200 sq.ft., in the Okkiyam Thoraipakkam Housing Scheme respectively. On the basis of the allotment orders dated 7.11.2002 and 23.9.2002, they had also paid the cost of the plots to the society and the no objection certificates were also issued to the petitioners on 18.3.2004 and 24.6.2008 for construction of the houses. Based on the no objection certificates, they had approached the local authority for planning permission. But the Corporation officials have asked for fresh no objection certificates from the Tamil Nadu Secretariat Employees Co-operative Housing Society. In view thereof, the petitioners again approached the President of the society for issuance of the no objection certificates and on the directions of the President, they have also filed affidavits attested by Notary Public stating that they are not the members in the Tamil Nadu Typists and Steno-typists Co-operative Housing Society, Madambakkam and no plots have been assigned to them. Even after receipt of the said affidavits and after repeated representations, the President of the society has not issued the no objection certificates. Hence they have made the representations on 25.1.2017 to the first respondent seeking appropriate action in the matter. As the same have not been considered, they have approached this Court.
3. Mr.V.Selvaraj, learned Additional Government Pleader, taking notice on behalf of the respondents, sought a week's time to dispose of the representations of the petitioners.
4. Since the representations of the petitioners for issuance of no objection certificates are pending for a long time, this Court directs the first respondent to consider the representations of the petitioners and pass appropriate orders within a period of ten days from the date of receipt of a copy of this order. The writ petitions are disposed of accordingly. No costs.
