JUDGMENT / ORDER

The learned counsel for the respondent submits with reference to the contents of the statement filed before this Court that, the petitioner has not approached this Court with clean hands and there is distorted version as well.
2. The learned counsel for the petitioner seeks to rebut the same, however adding that, the petitioner in view of the disputed question of fact, might be permitted to withdraw the writ petition, without prejudice to pursue other appropriate remedy.
3. The learned counsel for the Bank also contends that the sale is already over having conducted the same on 25.03.2014 and the bidder has not been included in the party array. It is also pointed out that the necessary sale certificate has already been issued as borne by Ext.R1(C).
In the said circumstance, nothing further remains to be considered in this writ petition and the writ petition is dismissed W.P.C.No. 25594 OF 2014 2 as withdrawn, without prejudice to the rights and liberties of the petitioner to pursue other appropriate remedy.
