JUDGMENT / ORDER

Heard learned counsel for the applicants and learned Additional Government Advocate for the State.
By moving the present application, charge sheet dated 19.6.2013 and order dated 2.12.2013 passed by Additional Chief Judicial Magistrate, Khurja, Bulandshahr in Criminal Case No. 1179 of 2013 arising out of Case Crime No. 255 of 2013 (State vs. Sayed Naushad Ali and another), under sections 498-A, 506 IPC and 3/4 Dowry Prohibition Act, PS Khurja, district Bulandshahr have been prayed to be quashed.
It has been argued that the offence in question is out come of the matrimonial hostility, which has been resolved between the parties, on the basis of which the decree of divorce has been granted and the case under Domestic Violence Act has been resolved by way of compromise between the parties.
Learned counsel for the applicants states that there are fair chances of mediation between the parties.
Having considered the facts, it is proper to refer the matter for mediation.
However, considering the facts and circumstances as also the request of the learned counsel for the applicants that there are chances of mediation, it is, hereby, ordered that in case the applicants deposit a sum of Rs.10,000/- within a period of one month from today, the office shall sent the matter to the Mediation Centre. Out of the sum so deposited, 75% of the amount shall be paid to opposite party No. 2, namely, Smt Azra Khan and the remaining amount shall be made available to the mediation centre. The mediation centre shall submit a report within a period of three months from today.
List thereafter.
Till then, no coercive process shall be issued against any of the applicants.
