(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) We would have considered the question of entertainment of the appeal preferred by the original compliantant in light of the circumstances that State have already preferred appeal being Criminal Appeal No.70 of 2012 with an application for leave to prefer appeal being Criminal Misc. Application No.851 of 2012 and the order passed by this Court granting leave to prefer appeal and admission of the appeal, in light of the decision of this Court dated 10.5.2010 in Criminal Misc. Application No.5522 of 2009 with Criminal Appeal No.783 of 2010, however, Mr.Tiwari, learned advocate for the appellant has filed leave note, S.O. to 2nd May, 2012.
