Heard Sri Devendra Kumar Shukla, learned counsel for the petitioner and Sri P.S. Jadaun, learned A.G.A. for the State-respondents.
This writ petition has been filed by the petitioner seeking direction to the police authorities to conduct fair and proper investigation in respect of Case Crime No. 0059 of 2018 for the offence under Sections 452, 354-B, 323, 504, 506 of I.P.C. and 3(1)(r) and 3(1)(s) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989, P.S. Madawara, District Lalitpur.
Grievance of the petitioner is that on 18.5.2018, she lodged the report against respondent no.4 for commission of offence under various provisions of law but till date nothing has been done by the police authorities. It has been argued that either the police authorities are protecting respondent no.4 or they are lethargic in their work. Learned counsel submits that purpose of filing this petition would be served if directions are issued to the police authorities to investigate the matter fairly and impartially.
State counsel submits that the police authorities are under the obligation to do the investigation fairly, impartially and expeditiously and the same would be done in accordance with law.
The present petition is disposed of directing the police authorities to conclude the investigation of the said case fairly and impartially within a period of two months in accordance with law on the basis of evidence so collected. In case, the investigation is not completed within the stipulated period, the petitioner would be at liberty to file appropriate reminder to the Superintendent of Police, Lalitpur. The petitioner would also be at liberty to approach this Court again, if any wilful disobedience is shown by the police authorities.
