Heard Shri Rajeev Kumar Singh, learned counsel for the petitioner and the learned Standing Counsel appearing for the respondent nos. 1 to 3.
In view of the order that is proposed to be passed, no notice is required to be served on the respondent nos.4 and 5.
This writ petition has been filed for a direction to the respondent no.3, Tehsildar, Tehsil Gola, District Gorakhpur to decide the mutation Case No.1224/2012-2013 (Computerized Case No.T201305317155), Savitri Devi Vs. Ram Pratap, expeditiously.
It is the contention of the learned counsel for the petitioner that by means of the sale deed dated 22 February 2013, the property in question was purchased by the petitioner and thereafter an application for mutation was filed on 1 March 2013. However, ever since then the mutation proceedings are pending before the respondent no.3 and are not being decided. Learned counsel has drawn the attention of the Court to the certified copy of the order-sheet that has been enclosed as Annexure-3 to the writ petition.
Learned Standing Counsel appearing for the State-respondents states that the Tehsildar shall decide the mutation case in three months.
In view of the facts and circumstances of the case, the respondent no.3-Tehsildar, Tehsil Gola, District Gorakhpur is directed to decide the aforesaid mutation case in accordance with law, after according opportunity of hearing to the parties concerned, expeditiously and preferably within a period of three months from the date of presentation of a certified copy of this order before him, provided there is no legal impediment. It is made clear that no unnecessary adjournment shall be granted to any of the parties concerned.
With the aforesaid observations, the writ petition is disposed of.
