Heard Sri Rajesh Kumar Dubey, learned counsel for the petitioner and Sri Gyan Prakash Srivastava, learned counsel for the Central Bank of India.
The petitioner is facing recovery under Section 13 (4) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 for a sum of Rs.11,24,696/- as on 18.7.2019.
Learned counsel for the petitioner at the very outset submits that without disputing the amount sought to be recovered, he is ready and willing to pay the entire amount provided some reasonable time is allowed.
Learned counsel for the bank is also interested in getting the amount cleared at the earlies.
In view of the aforesaid facts and circumstances, with the consent of the parties, we dispose off the writ petition with the direction to the petitioner to deposit a sum of Rs.3,24,696/- by 31st October, and the balance amount of Rs.8,00,000/- in four instalments of Rs.2,00,000/- each payable in the month of December, 2019, February, 2020, March, 2020 and 30th April, 2020. The last instalment will include up to date interest and the miscellaneous charges.
In the event of default of payment of any instalment, the benefit of this order would come to an end automatically.
