1. Sri Udit Chandra, learned counsel for petitioner, after some argument, states that since petitioner has a statutory alternative remedy under Section 17(4) of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the “Act, 2002”), therefore, he may be permitted to avail the same.
2. Sri Sanjai Singh, Advocate appearing for Respondent-Bank has no objection to aforesaid request.
3. Dismissed on the ground of alternative remedy.
