This is a petition filed under Section 24 of the Code of Civil Procedure seeking transfer of O.P. 873 of 2014 pending before the Family Court, Thrissur to Family Court, Palakkad.
2. Suffice to say, the marital relationship between the petitioner and the respondent ran into rough weather and though the couple have a child in the wedlock, the petitioner has instituted M.C. 387 of 2012 before the Family Court, Palakkad for maintenance.
3. According to the petitioner, as a counter blast, the respondent instituted O.P. 873 of 2014 for divorce before the Family Court, Thrissur.
4. The petitioner would say that she is finding it extremely difficult to go to Thrissur to attend the court on all Tr.P.(C).508/2014. 2 posting dates. Apart from the fact that she has an infant child, she is in financial difficulties also and she has nobody to accompany her to Thrissur to attend the court. Hence she prayed that the matter pending before the Family Court, Thrissur be transferred to Family Court, Palakkad and heard along with M.C. 387 of 2012.
5. Though notice was served on the counsel appearing for the respondent in the lower court, there is no response.
Since there is no objection raised by the respondent, this petition is allowed and O.P. 873 of 2014 pending before the Family Court, Thrissur shall stand transferred to Family Court, Palakkad.
